Ellerbe Creek Watershed Association
Date: July 23, 2019

Bid Document Set

The Ellerbe Creek Watershed Association (ECWA) is putting out a Request for Proposal (RFP) to install two bioretention cells along Rand Street on ECWA’s Pearl Mill Nature Preserve.

Release of bid documents will be solely for the convenience of the Contractor. No such document is a contract document. Please create your bid using the bid sheet provided. The bid documents are available online at the following link:

www.ellerbecreek.org/bid

ECWA will host an optional site visit on Monday, August 5th at 10:00am in order to familiarize bidders with the site and its constraints, and to answer any questions you may have.

ECWA will receive bids until Friday, August 16th.

The apparent Successful Bidder must submit to ECWA a list of the Subcontractors or Suppliers proposed within 14 days after Bid opening. If ECWA, after due investigation, has reasonable objection to any proposed Subcontractor or Supplier, ECWA may, before the Notice of Award is given, request apparent Successful Bidder to submit an acceptable substitute, in which case apparent Successful Bidder will submit a substitute, Bidder’s bid price will be increased (or decreased) by the difference in cost occasioned by such substitution, and ECWA may consider such price adjustment in evaluating Bids and making the Contract award.

Although unforeseen, any changes to the Construction Documents will require an addendum to the bid, with an acceptable increase or decrease in bid cost. ECWA may on its own initiative issue Addenda to clarify, correct, supplement, or change the Bid Documents.

ECWA reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. ECWA also reserves the right to waive all minor Bid informalities not involving price, time, or changes in the Work.

The site of these bioretention cells lies on land donated to ECWA by Duke Energy. As a result, much of the site is maintained as a current Duke Energy Transmission (DET) Line Right-of-Way. Several design elements were implemented to meet requirements set forth by DET, and thus strict adherence to the Construction Documents is required.
In addition, per DET guidelines, special care must be taken during the Construction Phase. These guidelines include the following:
  • No stockpiling or storage of materials, dirt, or equipment of any kind is permitted within the DET easement area.
  • Contractors operating any equipment may not operate within 25’ of poles, towers, or other electrical structures.
  • All slopes shall be 4:1 or less. No spoil dirt is to be placed within the right-of-way limits unless previously approved by DET.
  • All stormwater pipes must be capable of a heavy equipment load bearing weight of 80,000 lbs.
  • Any damage to the transmission line or its associated structures, relating to this project, and/or claims due to damage, will be the responsibility of the contractor.
  • No vegetation within the bioretention cells or on the berms may exceed a maximum height of 15’ at maturity.
  • Proper clearances must be maintained at all times. If any transmission line modification by DET is required, the cost will be the responsibility of the contractor. Any such line modifications must be approved and scheduled through DET well in advance of the project start date.
  • DET heavy equipment access must not be restricted during of this project due to grading or other activity.
Please take these guidelines into account when preparing your bid document.
Contractors will also be asked to maintain, on a primary basis and at their sole expense, at all times during the duration of the project, the following applicable insurance coverages and limits:

Commercial General Liability – Combined single limit of no less than $1,000,000 per occurrence and $2,000,000 aggregate. Coverage shall not contain any endorsement(s) excluding or limiting Product/Completed Operations, Contractual Liability, or Cross Liability.

ECWA will require a Certificate of Insurance showing the above policy as being currently valid, with ECWA listed as the Certificate Holder.
The above requirements, as well as ECWA’s review or acceptance of insurance maintained by the Contractor, is not intended to limit or qualify the liabilities or obligations assumed by the Contractor.

Contractors will be required to invoice ECWA by the 10th day of every month of the project’s duration for services rendered during the previous calendar month. ECWA will then process the invoice and request reimbursement from the appropriate funding partners (may take up to 28 days). Once ECWA receives the reimbursement from the funding partner, the contractor will be paid for the invoice within 5 business days.
